Miscarriage of Justice
Dear Sir/Madam,
I'm writing this letter out of desperation and hope. I am 41 years of age currently serving a 99 year sentence for a crime I did not commit (case #97-425172). I have been incarcerated for almost 24 years for "attempted capital murder).
On April 16, 1997 I was in my neighborhood, laying on the hood of my friends car. I was approached by a police, who asked me what was I doing. I told him I was waiting on my friend. The police informed me he was going to run a check for me to see if I had any warrants. While the police was running a check on me, he reached in my coat and grabbed a 9MM handgun. I tried to run, the police caught me, beat me up, then hit me in the head with a gun.
When I went to jail I just knew I was charged with unlawful carrying a weapon and resisting arrest. However I was wrong. I was charged with attempted capital murder. The gun was never fired, I never touch the gun, and the police didn't even have a scratch on him.
I went to trial. The first motion the DA filed was for the police not to have a polygraph examination taken on him. The judge granted the motion, all through trial the police testimony changed up.
